Acceptance of Terms<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">By accessing or using PhoneAIx (\u201c<strong>Service<\/strong>\u201d), you agree to be bound by these Terms &amp; Conditions (\u201c<strong>Terms<\/strong>\u201d). If you do not agree, you must discontinue use immediately.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These Terms apply to all users, subscribers, organizations, agents, contractors, and entities accessing PhoneAIx.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>2. Description of Service<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">PhoneAIx is a <strong>multi\u2011tenant SaaS platform<\/strong> providing agentic voice and communication solutions, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Inbound and outbound AI\u2011powered calls<\/li>\n\n\n\n<li>SMS messaging and automation<\/li>\n\n\n\n<li>Voice agents for sales, marketing, support, and receptionist workflows<\/li>\n\n\n\n<li>Hybrid phone systems (traditional + agentic)<\/li>\n\n\n\n<li>Twilio\u2011powered telephony services<\/li>\n\n\n\n<li>Multi\u2011LLM orchestration (OpenAI, Copilot, Gemini, Claude, ElevenLabs, and others)<\/li>\n\n\n\n<li>Mini\u2011CRM for leads and optional integration with <strong>DashCRM OS<\/strong><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Features may evolve as ZAMZILLA improves the platform.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>3. Eligibility<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">You must be at least 18 years old and legally able to enter into binding agreements to use the Service.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>4. Account Registration<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">You agree to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Provide accurate information<\/li>\n\n\n\n<li>Maintain the security of your credentials<\/li>\n\n\n\n<li>Accept responsibility for all activity under your account<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">ZAMZILLA may suspend or terminate accounts for violations of these Terms.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>5. Subscription, Billing &amp; Payments<\/strong><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>5.1 Subscription Model<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">PhoneAIx operates on a subscription basis. By subscribing, you authorize recurring charges until canceled.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>5.2 Billing<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>All fees are billed in advance<\/li>\n\n\n\n<li>Fees are non\u2011refundable unless required by law<\/li>\n\n\n\n<li>Prices may change with notice<\/li>\n\n\n\n<li>Usage\u2011based telephony fees (Twilio, carrier charges, call minutes, SMS volume) may apply<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>5.3 Cancellations<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">You may cancel at any time. Cancellation stops future billing but does not refund past charges.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>6. No Guarantees of Results<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">PhoneAIx does <strong>not<\/strong> guarantee:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Leads<\/li>\n\n\n\n<li>Sales<\/li>\n\n\n\n<li>Call outcomes<\/li>\n\n\n\n<li>Conversion rates<\/li>\n\n\n\n<li>Customer responses<\/li>\n\n\n\n<li>Business performance<\/li>\n\n\n\n<li>Deliverability of SMS or calls (carrier\u2011dependent)<\/li>\n\n\n\n<li>AI accuracy or reliability<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">All outcomes depend on your market, strategy, competition, and execution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This clause aligns with ZAMZILLA\u2019s global \u201cNo Guarantee\u201d policy.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>7. Telephony Services &amp; Compliance<\/strong><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>7.1 Twilio Integration<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">PhoneAIx integrates with Twilio for telephony services. You acknowledge that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Twilio\u2019s terms, carrier rules, and telecom regulations apply<\/li>\n\n\n\n<li>PhoneAIx is not responsible for Twilio outages, carrier filtering, or telecom restrictions<\/li>\n\n\n\n<li>You must comply with all applicable laws (TCPA, CTIA, FCC, GDPR, CAN\u2011SPAM, etc.)<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>7.2 Responsible Use<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">You agree <strong>not<\/strong> to use PhoneAIx for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Spam or unsolicited messaging<\/li>\n\n\n\n<li>Fraudulent or deceptive calls<\/li>\n\n\n\n<li>Harassment or abuse<\/li>\n\n\n\n<li>Illegal robocalling<\/li>\n\n\n\n<li>High\u2011risk or prohibited industries (unless approved)<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Violations may result in immediate termination.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>8. User Data &amp; Content<\/strong><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>8.1 Ownership<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">You retain ownership of:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Leads<\/li>\n\n\n\n<li>Contacts<\/li>\n\n\n\n<li>Call logs<\/li>\n\n\n\n<li>SMS logs<\/li>\n\n\n\n<li>Uploaded files<\/li>\n\n\n\n<li>CRM data<\/li>\n\n\n\n<li>Notes<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>8.2 License to Operate the Service<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">You grant PhoneAIx a limited license to process your data solely to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Provide the Service<\/li>\n\n\n\n<li>Improve performance<\/li>\n\n\n\n<li>Maintain security<\/li>\n\n\n\n<li>Deliver AI\u2011powered features<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">ZAMZILLA does <strong>not<\/strong> sell your data.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>8.3 Data Responsibility<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">You are responsible for ensuring you have the legal right to upload, store, or process any data you provide.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>9. Prohibited Activities<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">You agree <strong>not<\/strong> to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Reverse engineer PhoneAIx or any ZAMZILLA platform<\/li>\n\n\n\n<li>Copy or replicate workflows, agentic logic, or proprietary systems<\/li>\n\n\n\n<li>Reproduce GEO\/SEO structures<\/li>\n\n\n\n<li>Attempt unauthorized access<\/li>\n\n\n\n<li>Interfere with platform operations<\/li>\n\n\n\n<li>Use the Service for unlawful purposes<\/li>\n\n\n\n<li>Deploy agents that violate telecom or AI compliance laws<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Violations may result in termination and legal action.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>10. Intellectual Property<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">All PhoneAIx and ZAMZILLA intellectual property\u2014including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Software<\/li>\n\n\n\n<li>AI models<\/li>\n\n\n\n<li>Voice agents<\/li>\n\n\n\n<li>Workflows<\/li>\n\n\n\n<li>Automations<\/li>\n\n\n\n<li>Branding<\/li>\n\n\n\n<li>Designs<\/li>\n\n\n\n<li>Platform logic<\/li>\n\n\n\n<li>Multi\u2011agent orchestration<\/li>\n\n\n\n<li>Hybrid phone system architecture<\/li>\n\n\n\n<li>Templates and agentic frameworks<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">\u2014is owned exclusively by <strong>ZAMZILLA<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You receive a <strong>limited, non\u2011exclusive, non\u2011transferable license<\/strong> to use the Service during your subscription.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You may <strong>not<\/strong> copy, resell, sublicense, or replicate any part of the platform.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>11. AI, LLMs &amp; Voice Systems<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">By using PhoneAIx\u2019s AI features, you acknowledge:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>AI outputs may contain errors<\/li>\n\n\n\n<li>You are responsible for reviewing and verifying results<\/li>\n\n\n\n<li>AI\u2011generated content is provided \u201cas\u2011is\u201d<\/li>\n\n\n\n<li>LLM behavior may vary across providers<\/li>\n\n\n\n<li>You must comply with all laws when using AI for outreach, calling, or messaging<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>12. Third\u2011Party Services<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">PhoneAIx may integrate with third\u2011party tools (Twilio, CRMs, LLM providers, payment processors). ZAMZILLA is not responsible for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Third\u2011party outages<\/li>\n\n\n\n<li>Third\u2011party data handling<\/li>\n\n\n\n<li>Third\u2011party compliance failures<\/li>\n\n\n\n<li>Changes in third\u2011party pricing or policies<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>13. Service Availability<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">ZAMZILLA strives for high uptime but does not guarantee:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Uninterrupted service<\/li>\n\n\n\n<li>Error\u2011free performance<\/li>\n\n\n\n<li>Data availability at all times<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Maintenance, updates, or outages may occur.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>14. Termination<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">ZAMZILLA may suspend or terminate your account if you:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Violate these Terms<\/li>\n\n\n\n<li>Misuse the platform<\/li>\n\n\n\n<li>Engage in fraudulent or abusive behavior<\/li>\n\n\n\n<li>Breach telecom or AI compliance laws<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Upon termination:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Your license to use the Service ends<\/li>\n\n\n\n<li>ZAMZILLA may delete your data after a reasonable period<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>15. Limitation of Liability<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">To the fullest extent permitted by law:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">PhoneAIx and ZAMZILLA are <strong>not liable<\/strong> for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Loss of revenue<\/li>\n\n\n\n<li>Loss of leads<\/li>\n\n\n\n<li>Loss of data<\/li>\n\n\n\n<li>Business interruption<\/li>\n\n\n\n<li>Indirect, incidental, or consequential damages<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Total liability is limited to the amount you paid in the last 30 days.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>16. Indemnification<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">You agree to indemnify and hold harmless PhoneAIx, ZAMZILLA, and all affiliated entities from claims arising from:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Your use of the Service<\/li>\n\n\n\n<li>Your uploaded data<\/li>\n\n\n\n<li>Your calls, SMS messages, or AI agent actions<\/li>\n\n\n\n<li>Your violation of these Terms<\/li>\n\n\n\n<li>Your violation of applicable laws<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>17. Privacy<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Your use of the Service is governed by our <strong>Privacy Policy<\/strong>. By using PhoneAIx, you consent to our data practices.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>18. Modifications to Terms<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">ZAMZILLA may update these Terms at any time. Continued use of the Service constitutes acceptance of the updated Terms.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>19. Governing Law<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">These Terms are governed by the laws of the State of Nevada, without regard to conflict\u2011of\u2011law principles.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>20.
